UNIVERSITY COMMITTEE ON ACADEMIC GOVERNANCE

MINUTES

Thursday, November 4, 2004
3:15 p.m., 443A Administration Building

Present: Larabee, Meza, Weber, Lord, Melakeberhan, Hlasny, Gossain, Hughes, Tluzeck, Others: Harrison, Hunt, Wright

Absent:  DeJong, Spilotro, Peterson, Smith

The meeting was called to order at 3:27 p.m. with a quorum present.

Approval of Agenda:
The Agenda was approved by consent.

Approval of Minutes:
The minutes of October 7, 2004 were approved.

Libraries Bylaws Review:
Professor Larabee presented to UCAG the recommendations from the committee assigned to review the Libraries bylaws.

There were eight recommendations:

  1. How can the University Libraries build more student participation in their bylaws?

 It was suggested that there should be appointments of students to more committees in the libraries. There was a motion to approve the recommendation which was approved by consent.

  1. The Libraries bylaws are using the term “temporary” and should consider changing to “fixed term” librarians.

The recommendation was approved by consent.

  1. Are appendices an official part of the bylaws (the libraries have two very important appendices)

It was mentioned that appendices were an important part of the bylaws and should not be considered as an external part of the bylaws. It was moved to propose that the appendices be considered part of the bylaws, the motion was approved by consent.

  1. Appointment of Director (libraries bylaws section 2.1.1) – needs to be changed to be consistent with the University bylaws 2.1.3.1 re:  shared responsibility with the provost for procedures …..

By general consent the recommendation failed.

  1. Libraries bylaws section 1.3.2- why do these bylaws spell out the provost level as the next highest level under shared responsibility where University bylaws (1.3.3) do not spell this out.

By general consent the recommendation failed.  Dr. Hunt explained the technicalities behind why it was spelled that way, there was inconsistencies of reference to who the higher person in the office is. 

  1. Libraries bylaws 1.5.1 – dismissal for cause section – end of section states, “engaged in their work”.  In other words the Libraries use very general language as opposed to the Faculty Handbook to which the bylaws refer that “spells out” the work of the faculty.

 It was approved by general consent to “Ask the libraries staff for a clarification of the job, to spell out their duties.

  1. 1.9.1 of the libraries bylaws – in this section when the bylaws refer to library faculty do they mean all faculty including fixed term or not?

It was approved by general consent the motion to clarify by the libraries staff to spell out the meaning.

  1. 3.5.1.1 of the libraries bylaws states that the “director or designee shall GENERALLY be present at meetings of the steering committee…” Issue:  why the term generally?

It was motioned to recommend that the person should be present or be represented as ex-officio.

The meeting was adjourned at 4:47 p.m.
